These Terms of Service (“Terms”) govern access to the website, mobile apps and related WhisperEar services (“Service”) provided by the Service operator (“we”, “us”). By using the Service you agree to these Terms. If you do not agree, do not use the Service.

Our processing of personal data is described in the Privacy Policy.

1. Description of the Service

WhisperEar provides a personal audio guide: access to audio materials, information about points of interest and related features in the app and on the website. Features, content and usage limits may vary by plan (Guest, Free, Premium, etc.) and region. We may change, suspend or discontinue features with notice where reasonable, or without notice to fix outages and security issues.

2. Age and account

The Service is intended for users who can legally enter contracts in your jurisdiction (typically 18+). By registering you confirm accurate information and responsibility for account security and actions under your account. Notify us promptly of unauthorized access.

3. Plans, subscription and payment

  • Free and guest modes may include limits on listens, features or regions — as shown in the Service.
  • Paid subscriptions and one-time purchases, when available, are processed through listed payment intermediaries. Price, currency, taxes and billing are shown before payment.
  • Subscriptions may auto-renew if stated at purchase. You can cancel auto-renewal in account settings or the app store per Apple, Google or other distribution rules.
  • Refunds are governed by applicable law and the platform where you purchased, unless the offer states otherwise.

4. License to content

Audio, text, visuals, software and databases in the Service are protected by IP laws. We grant you a limited, non-exclusive, non-transferable license to access content for personal non-commercial use within the Service (including streaming where applicable).

Without our explicit written consent you may not:

  • copy, scrape, distribute or publicly perform content outside the Service;
  • bypass technical limits, DRM or geo-restrictions;
  • use content to train competing AI models or for commercial purposes.

5. Acceptable use

You may not:

  • violate laws, third-party rights or these Terms;
  • attempt unauthorized access to systems, other users’ accounts or data;
  • distribute malware, spam or misleading information;
  • use automated means (scraping, bots) to circumvent Service limits;
  • transfer or sell account access.

We may suspend or terminate access for violations or as required by authorities.

6. User content

If you send feedback or support messages, you warrant you have rights to provide them. You grant us a non-exclusive license to store and use such materials to operate and improve the Service and comply with law. Personal data is processed per the Privacy Policy.

7. Disclaimer

The Service is provided “as is” and “as available”. We aim for reliability but do not guarantee error-free operation or accuracy of descriptions and geo data. Route and place suggestions are informational; follow traffic laws and local rules.

8. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, punitive or consequential damages, lost profits or data loss. Aggregate liability is limited to amounts you paid for the Service in the prior twelve months (or the minimum required by law). Some jurisdictions do not allow certain limitations — mandatory rules apply.

9. Changes to Terms

We may update these Terms. The current version is on this page with the date. Material changes may be communicated via the Service or email. Continued use after changes may constitute acceptance where permitted by law.

10. Termination

You may stop using the Service and delete your account when available. We may restrict or terminate access for violations, non-payment or other lawful reasons. Provisions on IP, liability and disputes survive termination.

11. Governing law and disputes

These Terms are governed by applicable law and conflict-of-law rules, respecting mandatory consumer protections. Disputes may be brought in courts with jurisdiction. EEA and other consumers retain rights to contact authorities or alternative dispute bodies.
